"Personal injury" cases are a specific type of litigation matter that arises when one person suffers harm from an accident or injury, and someone else might be legally responsible for that harm.
A personal injury case can become formalized through civil court proceedings that seek to find others legally at fault through a court judgment or, as is much more common, such disputes may be resolved through informal settlement before any lawsuit is filed. Or the matter may be resolved by a quasi-judicial proceeding such as alternate dispute resolution.
The judicial system and the litigation process are confusing. Pleadings, motions, hearings, interrogatories, discovery, document requests, continuances, adjournments, negotiations, deadlines! These common concepts and occurrences in litigation can be overwhelming to the layman. Any potential personal injury case requires a detailed understanding of the facts, the processes, and the law. If an accident has impacted your life, you will want to consult with an experienced attorney to see if you should pursue a lawsuit
Be prepared, civil litigation can take a long time. It’s frustrating, but there is no way around it. Small cases can often get settled relatively quickly, but if you are involved in even a medium-sized case, it can easily take several years from the date of your injury until the day that you get your case settles. The judicial system is often a story of hurry up and wait. You just have to be patient. There is generally nothing that your lawyer can do about it
